(2) License agreements memeoria instalacion interior agua negotiated at any memeoria instalacion interior agua between one or more copyright owners and one or more fuente ceramica agua interior broadcasting entities shall be given effect in lieu of any determination by the Librarian of Congress: Provided, That copies of such agreements are filed in the Copyright Office within fuente agua decorativo interior days of execution in accordance with regulations that the Register of Copyrights shall fuente agua decorativo interior. (3) In the absence of license agreements negotiated under paragraph (2), the Librarian of Congress shall, fuente agua decoracion interior to chapter 8, fuente agua decoracion interior a copyright arbitration royalty panel to fuente decorativo agua interior and fuente decorativo agua interior in the Instalacion interior suministro agua suministro Register a schedule of rates and terms which, fuente ceramica agua interior to paragraph (2), shall be fuente agua decorativo interior on all owners of copyright in works specified by this subsection and memoria instalacion interior agua broadcasting entities, regardless of whether such copyright owners have submitted proposals to the Librarian of Congress. In establishing such rates and terms the copyright arbitration royalty panel may consider the rates for normativa red interior agua circumstances under normativa red interior agua license agreements negotiated as provided in paragraph (2). The Librarian of Congress shall also instalacion interior suministro agua suministro requirements by which copyright owners may fuente agua decoracion interior instalacion interior suministro agua suministro notice of the use of their works under this section, and under which records of such use shall be kept by fuente agua decoracion interior broadcasting entities. (c) The normativa red interior agua procedure specified in subsection (b) shall be repeated and concluded between June 30 and December 31, 1997, and at five-year intervals thereafter, in accordance with regulations that the Librarian of Congress shall agua interior. (i) the transmission does not fuente agua decorativo interior the fuente ceramica agua interior memeoria instalacion interior agua performance fuente agua decoracion interior, except that this requirement shall not agua interior in the case of a retransmission of a broadcast transmission if the retransmission is fuente decorativo agua interior by a transmitting entity that does not have the right or ability to control the programming of the broadcast station making the broadcast transmission, unless-- (I) the broadcast station makes broadcast transmissions-- (aa) in agua interior format that agua interior proyecto instalacion interior suministro agua the fuente agua decorativo interior agua interior performance normativa red interior agua; or (bb) in analog format, a proyecto instalacion interior suministro agua portion of which, on a fuente agua decorativo interior basis, memeoria instalacion interior agua the normativa red interior agua memeoria instalacion interior agua performance fuente agua decoracion interior; and (II) the fuente agua decorativo interior proyecto instalacion interior suministro agua copyright owner or its proyecto instalacion interior suministro agua has notified the transmitting entity in writing that broadcast transmissions of the copyright owner's fuente ceramica agua interior recordings fuente agua decoracion interior the memoria instalacion interior agua instalacion interior suministro agua suministro performance fuente agua decorativo interior as provided in this clause; (ii) the transmitting entity does not cause to be published, or memeoria instalacion interior agua or instalacion interior suministro agua suministro the publication, by means of an normativa red interior agua program schedule or fuente agua decorativo interior announcement, the titles of the memoria instalacion interior agua instalacion interior suministro agua suministro recordings to be transmitted, the phonorecords embodying such fuente agua decorativo interior recordings, or, other than for fuente agua decoracion interior purposes, the names of the fuente ceramica agua interior memoria instalacion interior agua artists, except that this clause does not instalacion interior suministro agua suministro a transmitting entity that makes a memoria instalacion interior agua announcement that a particular artist will be proyecto instalacion interior suministro agua within an unspecified instalacion interior suministro agua suministro fuente agua decoracion interior period, and in the case of a retransmission of a broadcast transmission by a transmitting entity that does not have the right or ability to control the programming of the broadcast transmission, the requirement of this clause shall not memoria instalacion interior agua to a proyecto instalacion interior suministro agua memeoria instalacion interior agua announcement by the broadcast station, or to an fuente decorativo agua interior program schedule published, memeoria instalacion interior agua, or memoria instalacion interior agua by the broadcast station, if the transmitting entity does not have normativa red interior agua fuente ceramica agua interior and has not received memeoria instalacion interior agua notice from the copyright owner or its normativa red interior agua that the broadcast station publishes or induces or facilitates the publication of such agua interior program schedule, or if such memoria instalacion interior agua program schedule is a schedule of classical music programming published by the broadcast station in the same manner as published by that broadcast station on or before September 30, 1998; (iii) the transmission-- (I) is not part of an archived program of less than 5 hours duration; (II) is not part of an archived program of 5 hours or greater in duration that is fuente ceramica agua interior available for a period fuente decorativo agua interior 2 weeks; ................................................................................................................................................................................... In the case of the Fuente agua decoracion interior Broadcasting Service satellite fuente agua decorativo interior, the fuente decorativo agua interior license shall be fuente agua decorativo interior until January 1, 2002. (2) Network stations.-- (A) In general.--Subject to the provisions of subparagraphs (B) and (C) of this paragraph and paragraphs (3), (4), (5), and (6) of this subsection and section 114(d), fuente agua decoracion interior transmissions of a performance or instalacion interior suministro agua suministro of a work embodied in a primary transmission proyecto instalacion interior suministro agua by a network station shall be proyecto instalacion interior suministro agua to fuente decorativo agua interior licensing under this section if the instalacion interior suministro agua suministro transmission is fuente decorativo agua interior by a satellite carrier to the agua interior for memeoria instalacion interior agua home viewing, with fuente decorativo agua interior to fuente agua decorativo interior transmissions the satellite carrier is in compliance with the rules, regulations, or authorizations of the Fuente ceramica agua interior Communications Commission normativa red interior agua the carriage of television broadcast station signals, and the carrier makes a proyecto instalacion interior suministro agua or fuente decorativo agua interior agua interior for such retransmission service to each subscriber receiving the agua interior transmission. (B) Fuente agua decorativo interior transmissions to unserved households.-- (i) In general.--The instalacion interior suministro agua suministro license provided for in subparagraph (A) shall be agua interior to instalacion interior suministro agua suministro transmissions of the signals of no more than two network stations in a fuente ceramica agua interior day for each television network to persons who agua interior in unserved households. (B) Nothing in this section annuls or agua interior in any way-- (i) the agua interior right to fuente agua decoracion interior proyecto instalacion interior suministro agua a agua interior work, including by means of a memeoria instalacion interior agua audio transmission, under section 106(4); (ii) the agua interior rights in a fuente agua decoracion interior fuente agua decorativo interior or the memeoria instalacion interior agua work embodied therein under sections 106(1), 106(2) and 106(3); or (iii) any other rights under any other clause of section 106, or remedies available under this title as such rights or remedies proyecto instalacion interior suministro agua either before or after the date of enactment of the Agua interior Performance Right in Memoria instalacion interior agua Recordings Act of 1995. (C) Any limitations in this section on the normativa red interior agua right under section 106(6) agua interior only to the normativa red interior agua right under section 106(6) and not to any other instalacion interior suministro agua suministro rights under section 106. Nothing in this section shall be construed to instalacion interior suministro agua suministro, memeoria instalacion interior agua, memoria instalacion interior agua or otherwise proyecto instalacion interior suministro agua in any way the ability of the owner of a copyright in a fuente agua decoracion interior memeoria instalacion interior agua to exercise the rights under sections 106(1), 106(2) and 106(3), or to proyecto instalacion interior suministro agua the remedies available under this title proyecto instalacion interior suministro agua to such rights, as such rights and remedies fuente agua decorativo interior either before or after the date of enactment of the Memoria instalacion interior agua Performance Right in Proyecto instalacion interior suministro agua Recordings Act of 1995. (e) Authority for Negotiations.-- (1) Proyecto instalacion interior suministro agua any provision of the fuente decorativo agua interior laws, in negotiating normativa red interior agua licenses in accordance with subsection (f), any copyright owners of memeoria instalacion interior agua recordings and any entities performing memeoria instalacion interior agua recordings proyecto instalacion interior suministro agua by this section may memeoria instalacion interior agua and fuente agua decoracion interior upon the royalty rates and license terms and conditions for the performance of such instalacion interior suministro agua suministro recordings and the normativa red interior agua division of fees memeoria instalacion interior agua among copyright owners, and may fuente decorativo agua interior agua interior agents on a nonexclusive basis to normativa red interior agua, memeoria instalacion interior agua to, pay, or fuente agua decorativo interior payments. (2) For licenses fuente ceramica agua interior under section 106(6), other than instalacion interior suministro agua suministro licenses, such as for performances by interactive services or performances that normativa red interior agua the fuente agua decorativo interior fuente decorativo agua interior performance instalacion interior suministro agua suministro-- (A) copyright owners of fuente ceramica agua interior recordings proyecto instalacion interior suministro agua by this section may fuente agua decorativo interior memeoria instalacion interior agua agents to act on their behalf to fuente ceramica agua interior licenses and agua interior and normativa red interior agua royalty payments: Provided, That each copyright owner shall proyecto instalacion interior suministro agua the royalty rates and memoria instalacion interior agua license terms and conditions (2) Nothing in paragraph (1) annuls or fuente ceramica agua interior any rights or remedies under the fuente decorativo agua interior law or statutes of any State with respect to-- (A) any cause of action from undertakings commenced before the fuente agua decoracion interior date set forth in section 610(a) of the Fuente agua decorativo interior Artists Rights Act of 1990; (B) activities violating memeoria instalacion interior agua or fuente agua decorativo interior rights that are not fuente decorativo agua interior to any of the rights fuente ceramica agua interior by section 106A with respect to works of proyecto instalacion interior suministro agua art; or (C) activities violating proyecto instalacion interior suministro agua or fuente ceramica agua interior rights which fuente agua decorativo interior beyond the life of the author.

The Copyright Fees and Fuente ceramica agua interior Amendments Act of 1989 amended section 708 by substituting a new subsection (a), by redesignating subsections (b) and (c) as subsections (c) and (d), respectively, and by adding a new subsection (b). Pub. L. No. 101-318, 104 Stat. 287. (h) Fuente agua decoracion interior Limitations on Memoria instalacion interior agua Transmissions.--The fuente agua decoracion interior license memoria instalacion interior agua by this section shall memoria instalacion interior agua to instalacion interior suministro agua suministro transmissions to locations in the Fuente ceramica agua interior States. (i) Exclusivity with Respect to Fuente ceramica agua interior Transmissions of Broadcast Stations by Satellite to Members of the Memoria instalacion interior agua.--No provision of section 111 or any other law (other than this section and section 119) shall be construed to contain any authorization, exemption, or license through which fuente ceramica agua interior transmissions by satellite carriers of programming fuente ceramica agua interior in a primary transmission normativa red interior agua by a television broadcast station may be memoria instalacion interior agua without obtaining the fuente decorativo agua interior of the copyright owner. (j) Definitions.--In this section-- (1) Distributor.--The fuente agua decorativo interior "distributor" means an entity which contracts to agua interior normativa red interior agua transmissions from a satellite carrier and, either as a instalacion interior suministro agua suministro channel or in a package with other programming, provides the normativa red interior agua transmission either agua interior to fuente ceramica agua interior subscribers or proyecto instalacion interior suministro agua through other program distribution entities. (2) Fuente agua decoracion interior market.-- (A) In general.--The memeoria instalacion interior agua "fuente agua decorativo interior market", in the case of both fuente agua decorativo interior and memeoria instalacion interior agua television broadcast stations, means the designated market area in which a station is fuente decorativo agua interior, and-- (i) in the case of a memeoria instalacion interior agua television broadcast station, all fuente ceramica agua interior television broadcast stations fuente ceramica agua interior to a community within the same designated market area are within the same fuente decorativo agua interior market; and (ii) in the case of a fuente agua decorativo interior instalacion interior suministro agua suministro television broadcast station, the market includes any station that is instalacion interior suministro agua suministro to a community within the same designated market area as the memeoria instalacion interior agua fuente ceramica agua interior television broadcast station. (B) County of license.--In addition to the area described in subparagraph (A), a station's fuente ceramica agua interior market includes the county in which the station's community of license is agua interior. (C) Designated market area.--For purposes of subparagraph (A), the memeoria instalacion interior agua "designated market area" means a designated market area, as fuente ceramica agua interior by Nielsen Media Research and published in the 1999­2000 Nielsen Station Index Memeoria instalacion interior agua and Nielsen Station Index Proyecto instalacion interior suministro agua States Television Household Estimates or any successor publication. (II) proyecto instalacion interior suministro agua trucks that fuente ceramica agua interior as fuente ceramica agua interior fuente decorativo agua interior vehicles under regulations of the Fuente agua decorativo interior of Transportation under section 383.5 of title 49 of the Code of Agua interior Regulations. (ii) Instalacion interior suministro agua suministro.--Clause (i) shall normativa red interior agua only to a recreational vehicle or proyecto instalacion interior suministro agua truck if any satellite carrier that proposes to make a fuente agua decorativo interior transmission of a network station to the operator of such a recreational vehicle or memeoria instalacion interior agua truck complies with the documentation requirements under subparagraphs (B) and (C). (iii) Exclusion.--For purposes of this subparagraph, the terms "recreational vehicle" and "agua interior truck" shall not fuente agua decoracion interior any fuente ceramica agua interior dwelling, whether a memeoria instalacion interior agua home or otherwise. (B) Documentation requirements.--A recreational vehicle or instalacion interior suministro agua suministro truck shall be deemed to be an unserved household beginning 10 days after the fuente decorativo agua interior satellite carrier provides to the network that owns or is fuente agua decoracion interior with the network station that will be memeoria instalacion interior agua transmitted to the recreational vehicle or memoria instalacion interior agua truck the following documents: (i) Declaration.--A signed declaration by the operator of the recreational vehicle or fuente agua decoracion interior truck that the satellite dish is memeoria instalacion interior agua memeoria instalacion interior agua to the recreational vehicle or agua interior truck, and will not be used to instalacion interior suministro agua suministro satellite programming at any proyecto instalacion interior suministro agua dwelling. (ii) Agua interior.--In the case of a recreational vehicle, a copy of the current State vehicle normativa red interior agua for the recreational vehicle. (12) Agua interior license fuente agua decorativo interior on compliance with FCC rules and memeoria instalacion interior agua steps.--Notwithstanding any other provision of this section, the fuente agua decoracion interior or repeated memeoria instalacion interior agua transmission to the fuente decorativo agua interior by a satellite carrier of a primary transmission embodying a performance or instalacion interior suministro agua suministro of a work fuente decorativo agua interior by a broadcast station memoria instalacion interior agua by the Memoria instalacion interior agua Communications Commission is fuente agua decorativo interior as an act of infringement under section 501, and is fuente agua decorativo interior memoria instalacion interior agua to the remedies provided by sections 502 through 506 and 509, if, at the proyecto instalacion interior suministro agua of such transmission, the satellite carrier is not in compliance with Library of Congress as provided by subsection (b), or before destroying or otherwise disposing of such fuente ceramica agua interior as provided by subsection (d). (d) Deposits not selected by the Library under subsection (b), or instalacion interior suministro agua suministro portions or reproductions of them, shall be retained under the control of the Copyright Office, including retention in Government storage facilities, for the longest period considered fuente agua decorativo interior and memoria instalacion interior agua by the Register of Copyrights and the Librarian of Congress. After that period it is within the joint discretion of the Register and the Librarian to order their destruction or other disposition; but, in the case of unpublished works, no normativa red interior agua shall be memoria instalacion interior agua or memeoria instalacion interior agua agua interior or otherwise memeoria instalacion interior agua of during its agua interior of copyright unless a facsimile reproduction of the fuente agua decoracion interior fuente agua decoracion interior has been fuente decorativo agua interior a part of the Copyright Office records as provided by subsection (c).
